National Catalogue of Hazardous Wastes is formulated in accordance with Law of the People's Republic of China on Prevention and Control of Environmental Pollution by Solid Waste and hereby promulgated. It goes into effect as of August 1, 2008.

National Catalogue of Hazardous Wastes (issued by National Environmental Protection Agency, No. 89, 1998), which is promulgated by National Environmental Protection Agency, State Economy & Trade Committee, the Ministry of Foreign Trade & Economic Cooperation and the Ministry of Public Security on January 4, 1998 is abolished.

National Catalogue of Hazardous Wastes

Article 1 This Catalogue is formulated in accordance with Law of the People's Republic of China on Prevention and Control of Environmental Pollution by Solid Wastes.

Article 2 Solid and liquid wastes that comply with the following conditions shall be included in this Catalogue:

1. possessing one or more hazardous properties, that is, corrosivity, toxicity, ignitability, reactivity or infectivity.

2. not excluding the possibility of hazardous properties but may have harmful impacts on the environment or people's health and need to be managed as hazardous waste.

Article 3 Medical wastes belong to hazardous wastes. The Catalogue for Classification of Medical Wastes is otherwise formulated and promulgated in accordance with Regulations on the Administration of Medical Wastes.

Article 4 Solid and liquid wastes that are not included in this Catalogue or the Catalogue for Classification of Medical Wastes and identified, according to the national standards and methods to identify hazardous wastes and by experts who are organized by the competent environmental protection department under the State Council, to possess hazardous properties and thus belong to hazardous waste shall be added to this Catalogue at a proper timing.

Article 5 The nature of the compound of hazardous waste and non-hazardous waste shall be determined in accordance with the national standard for identifying hazardous wastes.

Article 6 Waste medicines and their packages, waste pesticides, disinfectants and their packages, waste paints, solvents and their packages, waste mineral oils and their packages, waste films and photo paper, waste fluorescent light tubes, waste thermometers, waste blood-pressure meters, waste nickel-cadmium cells, mercuric-oxide cells and electronic hazardous wastes that are produced by households in daily life may not be managed as hazardous wastes.

After the wastes listed in the preceding paragraph are separated from domestic garbage and collected, they shall be transported, stored, used or disposed as hazardous wastes.

Article 7 The competent environmental protection department under the State Council shall, according to the need for environmental management of hazardous wastes, adjust and release this Catalogue at a proper timing.

Article 8 For the purpose of this Catalogue, the meanings of the glossary are as follows:

1. "Category of the waste" means the category designated by Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes.

2. "Source of the waste" means the source of a certain hazardous waste.

3. "Code of the waste", which consists of eight digits, is the only code for hazardous waste. The first three digits is the code for the industry that produces the hazardous waste, the fourth to sixth digits is the serial code of the waste, and the last two digits is the code for the waste's category.

4. "Hazardous properties" means Corrosivity (C), Toxicity (T), Ignitability (I), and Infectivity (In).

Article 9 This Catalogue is effective as of August 1, 2008. National Catalogue of Hazardous Wastes (issued by National Environmental Protection Agency, No. 89, 1998), which is promulgated by National Environmental Protection Agency, State Economy & Trade Committee, the Ministry of Foreign Trade & Economic Cooperation and the Ministry of Public Security on January 4, 1998 is abolished.
